Please read carefully. By accessing or using Claustaff, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and Claustaff ("Claustaff", "we", "us") governing your access to and use of the Claustaff platform and website at claustaff.com ("Service").

By creating an account, making a purchase, or using the Service, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.

2. Description of Service

Claustaff provides a cloud-based AI platform enabling businesses to deploy AI-powered voice calling agents and website assistant chatbots. The Service includes:

  • AI outbound and inbound voice agents connected via third-party telephony providers (Twilio, Telnyx)
  • AI website assistant widgets embeddable on third-party websites
  • CRM integrations (GoHighLevel, Salesforce, Zoho)
  • Automation integrations (Zapier, Make, n8n)
  • AI model access (GPT-5, Gemini, Claude, and others)
  • Voice cloning capabilities
  • Done-For-You (DFY) setup services
  • Analytics and reporting dashboard

The Service requires you to maintain your own accounts with third-party telephony providers. Claustaff is not a telephony provider and does not hold or manage phone numbers directly.

3. Eligibility

You must be at least 18 years of age to use the Service. The Service is intended for business use only. By using Claustaff, you represent that you are using it for lawful business purposes and not for personal, family, or household use.

The Service is available to users in the United States, Canada, United Kingdom, European Union, Australia, and other countries where AI voice calling is permitted by applicable law. It is your responsibility to determine whether your use of the Service complies with local laws in your jurisdiction.

4. Accounts & Registration

To access the Service you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain the security of your account credentials
  • Not share your account with third parties
  • Notify us immediately at info@claustaff.com of any unauthorised access to your account
  • Accept responsibility for all activity under your account

We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

5. Fees, Billing & Refunds

5.1 Pricing

  • Growth Plan: $49 per month subscription, plus $0.12 per minute of AI calling (credit-based)
  • Done-For-You Setup: $297 one-time setup fee, plus $49/month Growth Plan subscription
  • Agency / Enterprise: custom pricing as agreed in writing

5.2 Billing

Subscriptions are billed monthly. Calling credits are charged on actual usage and never expire. Payments are processed by PayPal. By providing payment details, you authorise us to charge the applicable fees.

5.3 Trial Verification Charge

A $1.00 verification charge may be collected at signup to confirm your payment method and prevent platform misuse. This charge is refunded to your original payment method within 48 hours of collection.

5.4 Refund Policy

  • The $1.00 verification charge is fully refunded within 48 hours
  • The $297 DFY setup fee is non-refundable once onboarding has commenced (within 24 hours of payment)
  • Monthly subscription fees are non-refundable once a billing period has started
  • Unused calling credits are non-refundable but do not expire
  • If we are unable to deliver the DFY service within the agreed timeframe due to our fault, we will issue a full refund of the setup fee

5.5 Price Changes

We reserve the right to change our pricing with 30 days' notice. Continued use after the notice period constitutes acceptance of the new pricing.

6. Free Trial

We offer a 3-day free trial on all plans for a limited time. During the trial period you have full access to platform features. At the end of the trial, your subscription will automatically commence at the applicable monthly rate unless you cancel before the trial ends. Cancellation during the trial period incurs no charge beyond the $1.00 verification fee (which is refunded as per Section 5.3).

7. Acceptable Use Policy

You agree NOT to use the Service to:

  • Make calls to individuals who have not consented or who are on Do-Not-Call registries without proper authorisation
  • Impersonate a human without disclosing that the caller is an AI where required by law
  • Engage in spam, phishing, fraud, harassment, or any deceptive practices
  • Violate any applicable law, including telemarketing, consumer protection, or data privacy laws
  • Transmit malware, viruses, or harmful code
  • Reverse engineer, copy, or resell the Service without written permission
  • Use the Service for any illegal, abusive, or harmful purpose
  • Collect personal data from call recipients beyond what is required for your stated business purpose
  • Use voice cloning to impersonate real individuals without their consent
Violation of this policy may result in immediate account suspension without refund and may be reported to relevant authorities.

8. AI Calling — Legal Compliance

You acknowledge and agree that:

  • You are solely responsible for ensuring your use of Claustaff's calling features complies with all applicable laws, including the Telephone Consumer Protection Act (TCPA) in the US, Canada's Anti-Spam Legislation (CASL), the UK's Privacy and Electronic Communications Regulations (PECR), the EU's ePrivacy Directive, and Australian telemarketing laws
  • You must obtain all legally required consents before making AI calls to individuals
  • You must honour all Do-Not-Call requests promptly
  • Where required by law, you must disclose at the start of a call that the caller is an AI agent
  • You must maintain your own Do-Not-Call list and suppress contacts who have opted out
  • Claustaff is a technology platform and is not liable for your compliance failures

9. Intellectual Property

Claustaff and its licensors retain all intellectual property rights in the Service, including all software, designs, trademarks, and content. These Terms do not grant you any ownership rights — only a limited, non-exclusive, non-transferable licence to use the Service for your internal business purposes during your subscription.

You retain ownership of all data, content, and materials you upload to the platform ("Your Content"). By uploading content, you grant Claustaff a limited licence to use it solely to provide the Service to you.

10. Your Data

You are responsible for the accuracy and legality of all data you upload or transmit through the Service, including contact lists, business information, and voice samples. You represent that you have the right to use and share such data with us for the purposes of the Service.

Our collection and use of your data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

11. Third-Party Services

The Service integrates with third-party platforms (PayPal, Twilio, Telnyx, GoHighLevel, Salesforce, Zoho, Zapier, Make, OpenAI, Google, Anthropic, Cal.com, Calendly, and others). Your use of these third-party services is subject to their own terms and privacy policies. Claustaff is not responsible for the availability, accuracy, or conduct of third-party services.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that: (a) the Service will be uninterrupted or error-free; (b) AI calling agents will achieve any specific business results; (c) the Service will meet your specific requirements; or (d) any results obtained through the Service will be accurate or reliable.

AI-generated content, calls, and conversations may contain errors. You are responsible for reviewing and supervising your AI agents' performance.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CLAUSTAFF SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO CLAUSTAFF IN THE 3 MONTHS PRECEDING THE CLAIM; OR (B) $100 USD.

Nothing in these Terms excludes or limits liability that cannot be excluded by law, including liability for fraud, death, or personal injury caused by negligence (UK/EU/Australia).

14. Indemnification

You agree to indemnify, defend, and hold harmless Claustaff and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law, including telemarketing and consumer protection laws; (d) any claim by a third party relating to calls made by your AI agents; or (e) your infringement of any intellectual property or privacy rights.

15. Termination

You may cancel your subscription at any time through your account settings or by emailing info@claustaff.com. Cancellation takes effect at the end of the current billing period.

We may suspend or terminate your account immediately, without notice or refund, if you: (a) violate these Terms or our Acceptable Use Policy; (b) fail to pay applicable fees; (c) engage in conduct that we determine poses a legal or reputational risk to Claustaff or other users.

Upon termination, your right to use the Service ceases immediately. We will retain your data in accordance with our Privacy Policy and applicable law.

16. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws applicable to your jurisdiction:

  • United States users: the laws of the State of Delaware, USA, without regard to conflict of law principles. Disputes shall be resolved by binding arbitration under the AAA Commercial Arbitration Rules, except that either party may seek injunctive relief in court for IP violations.
  • UK users: the laws of England and Wales. Disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
  • EU users: the laws of your country of residence apply where required by EU consumer protection law.
  • Canadian users: the laws of the Province of Ontario, Canada.
  • Australian users: the laws of New South Wales, Australia.

Before initiating any formal dispute, you agree to contact us at info@claustaff.com and attempt to resolve the matter informally within 30 days.

17. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by a prominent notice on the website at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
